Welcome to PhDSucks! These Terms & Conditions (“Terms”) govern your access to and use of our website, AI-powered application services, and subscription plans (collectively, the “Services”), specifically tailored for PhDs in AI, Data, and Engineering.

By accessing or using PhDSucks, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

By creating an account or using our Services, you represent that you:

  • Are at least 18 years old.
  • Have the legal capacity to enter into these Terms.
  • Are using the Services to seek genuine professional employment.

If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Services

PhDSucks provides an automated platform that helps users:

  • Upload and Manage professional materials (Resumes, CVs, cover letters).
  • Search and browse job opportunities suitable for PhD holders.
  • Use AI-powered tools to automatically tailor resumes and cover letters to job descriptions.
  • Submit mass job applications (up to 100+ per month, depending on your plan).
  • Track application status and manage job search activities.

3. User Accounts and Responsibilities

(a) Account Security

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to notify us immediately of any unauthorized use of your account.
  • You are responsible for all activities that occur under your account.

(b) Accurate Information

You agree to provide accurate, current, and complete information when creating your account and using our Services. You are responsible for updating your information to keep it accurate and current. We reserve the right to suspend or terminate accounts containing false or misleading information.

(c) Prohibited Conduct

You agree not to:

  • Use the Services for any illegal or unauthorized purpose.
  • Violate any laws in your jurisdiction (including but not limited to intellectual property laws or labor laws).
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Upload false, misleading, or fraudulent information, including fictitious academic or professional experience.
  • Attempt to gain unauthorized access to our systems, servers, or other users’ accounts.
  • Interfere with or disrupt the Services or servers connected to the Services.
  • Use automated systems (e.g., bots, scripts, scrapers) to access the Services in ways not intended or explicitly permitted by us.
  • Scrape, copy, or redistribute any content from the Services without our explicit permission.
  • Use the automated application features to harass, spam, or overwhelm employers with bad faith applications.

4. Subscriptions, Payments, and Billing

(a) Pricing

The current price for the standard subscription plan is $13.99 per month. We reserve the right to change our pricing upon prior notice to you.

(b) Auto-Renewal

Your subscription will automatically renew each month unless you cancel it. You authorize us to charge the payment method on file on the renewal date of your subscription.

(c) Cancellation

You may cancel your subscription at any time. To avoid the next month’s charge, you must cancel your subscription before your renewal date. You can cancel through your account settings.

(d) Refunds

All payments are non-refundable, except as required by applicable law.

5. AI-Generated Content

  • PhDSucks uses artificial intelligence to help generate and tailor resumes, cover letters, and application responses.
  • You are solely responsible for reviewing and approving all AI-generated content before submission to employers.
  • While we strive for “Code Quality” and relevance, we do not guarantee the accuracy, completeness, or suitability of AI-generated content.
  • You acknowledge that AI-generated content is provided as a tool to assist you, and you retain full responsibility for the quality and veracity of your job applications.

6. Intellectual Property

(a) Our Content

All content, features, and functionality of the Services (including software, text, graphics, logos, designs, and AI algorithms) are owned by PhDSucks or its licensors and are protected by copyright, trademark, and other intellectual property laws.

(b) Your Content

You retain ownership of any content you upload to PhDSucks (including resumes, cover letters, and other materials). By uploading content, you grant us a limited, worldwide license to:

  • Store, process, and display your content as necessary to provide the Services.
  • Use your content to generate AI-powered suggestions and improvements (for your exclusive use).
  • Submit your content to job boards and employers when you choose to use the automated application features of our platform.

7. Third-Party Services

PhDSucks may integrate with third-party job boards, applicant tracking systems, and other services (e.g., Stripe for payment processing). We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is subject to their respective terms and conditions.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • Guarantees that the Services will be uninterrupted, secure, or error-free.
  • Guarantees regarding job placement, interview opportunities, or employment outcomes.
  • Accuracy or reliability of AI-generated content.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHDSUCKS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, revenue, data, or business opportunities.
  • Damages resulting from your use of or inability to use the Services.
  • Errors or inaccuracies in AI-generated content.
  • Actions or omissions of third-party job boards or employers to whom you submit applications.

10. Indemnification

You agree to indemnify, defend, and hold harmless PhDSucks and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Services, violation of these Terms, or infringement of any rights of another party.

11. Termination

We reserve the right to suspend or terminate your account and access to the Services at any time, with or without notice, for:

  • Violation of these Terms.
  • Fraudulent or illegal activity.
  • Failure to make required payments.
  • Any conduct that we believe is harmful to PhDSucks, other users, or third parties.

You may terminate your account at any time by contacting us or using the account deletion feature within your settings. Upon termination, your right to use the Services will immediately cease.
